Regular Board Meeting
February 1-2, 2005

Chairman Birdsall called the meeting to order at 9:00a.m.

Dr. Fischer moved to approve the minutes of October 5-6, 2004, as amended.  Mr. Shiosaki seconded the motion and it carried.

Dr. Jones moved to approve the minutes of October 21, 2004 conference call as amended. Dr. Freeman seconded the motion and it carried.

The Investigative Report was presented to the Board showing that for year 2005, 16 complaints have been received and 13 are under investigation.  For year 2004, 26 were received and 13 are under investigation. For year 2003, 21 complaints were received.

For year 2002, 14 complaints were received and one is open.

Ms. Guyon presented Disciplinary Complaints to the Board for review and action.

COU-2005-2   Dr. Fischer moved to accept the recommendation of the Bureau Staff and appreciates them checking with attorneys.  Ms. Crockett seconded the motion, and it carried.

Mr. Stringfield presented a stipulation and consent order to the Board. COU-2004-4

Ms. Crockett moved to accept the stipulation and consent order with Chairman Birdsall to sign on behalf of the Board.  Dr. Fischer seconded the motion and the motion carried.

Ms. Jacobsen reported that House Bill 45, which eliminates Conditional  Licensure, adds an administrative fee and raises the cap on fees will go into hearing next.

Marci McGinty, Administrative Assistant, gave each Board member a disk to review and a conference call is to be set within 8 days.

Discussion was held on the supervision of Three in Rules.  The Social Workers, Psychologists and Board of Professional Counselors and Marriage & Family Therapy need to get together to discuss the supervision of three counselors after the Legislative session. Robert Payne, Chairman of the Social Work Board, has invited the Board members to meet with the Social Work Board to discuss legislation.

The financial report was presented to the Board and shows a remaining balance of $74,000.  This is 62.19 percent of the budget spent.  Mr. Shiosaki moved to approve the financial report.  Dr. Jones seconded and the motion carried.

Portability was discussed and Tier II contains requirements for psychopathology, which is not in Idaho’s Law.  The National Clinical Mental Health Counselors Examination is also used for Tier II.  The American Association of State Counseling Boards will present more information.  The Idaho Counseling Association in 2006 will need input from the membership on portability. Four thousand hours are required for Tier II.

This issue is to be put on the website and ask for “written” comments and add frequently asked questions.

Jun Shiosaki moved that Chairman Birdsall and Ms. Crockett develop strategies and write the Association letters for feedback.  Associations are to send feedback first.  Dr. Fischer seconded the motion and it carried.

Loopholes in the graduate students supervision were discussed.  1.  People applying for the LCPC may have three months delay between the application for LPC and Board review.  Some want to start counting hours after the application for LPC has been sent in but before Board review for the LPC licensure.  2.  People applying for the Licensed Marriage & Family Therapy Intern license cannot count hours until the Board has approved the Intern status.  Chairman Birdsall is to draft letters in response to these.

NEW BUSINESS

  1. Clarification needs to be done on Rule 200.02 Supervision of three. This is supervision for licensure and not administrative supervision. The Board had no intent to limit the number of supervisees, just how many can be in a supervision setting at one time.  After the moratorium, new rules can be drafted. Further discussion will be held at the May meeting. Dr. Jones is to gather information for discussion.
     
  1. An LCPC Registered Supervisor MUST supervise the 1,000 hours of supervision for LCPC licensure.  A Psychologist, Psychiatrist, Clinical Social Worker or Marriage & Family Registered Supervisor can supervise the other 1,000 hours.  Ms. Crockett is to respond to this letter.

 AASCB REPORT

One item to be discussed is a criminal background check for licensure. This is one of the portability requirements.  A law change is needed in Idaho to require a background check.  This costs about $45 for the applicant to get a criminal background check and it can be done through the State Police Department. 

AASCB wants to know if Idaho wants to participate in the National Data Base. This would require a law change as well and the costs were not discussed.  Dr. Jones is to send an e-mail to Board members.   Mr. Shiosaki moved to generally support Ms. Crockett’s response to this letter and ask for further details, costs, etc. on the National Data Bank. Dr. Freeman seconded the motion.  Dr. Jones amended the motion to include confidentiality and procedural issues as well. Mr. Shiosaki accepted the amendment and Dr. Freeman seconded the motion, and the motion carried.

Discussion was held on interns being reimbursed for MEDICAID.  The internship is a permit and MEDICAID requires a license to reimburse with MEDICAID payments. 

Chairman Birdsall is to attend other Association meetings for discussion on MEDICAID payments to interns. Ms. Crockett moved to have a subcommittee, including Piper Field, and Cameron Preece, meet with Idaho Mental Health Counseling Association, Idaho Counseling Association and Health and Welfare to discuss the interns being reimbursed by MEDICAID.  Dr. Fischer seconded the motion and it carried.

The Idaho Mental Health Counseling Association’s newsletter had an article saying the Idaho Professional Counselor Licensing Board is not in compliance regarding the Board members.  Chairman Birdsall is to contact the IMCA President on this issue.

Ms. Crockett, Dr. Jones and Mr. Shiosaki’s terms end on July 1, 2005.  Mr. Shiosaki has served two full terms.  Ms. Crockett and Dr. Jones have each served one term. Letters are to be sent to the Idaho Counselor Association and Idaho Marriage & Family Therapy Association.
 

Clarification of Psychosocial Rehabilitation  (PSR)

PSR was further discussed and PSR experience will be approved when it is counseling in nature and all other requirements are met per Idaho Law and Rules.

The National Board For Certified Counselors (NBCC) requests that Idaho join in a job analysis of the National Clinical Mental Health Examination  (NCMHCE) and what Clinical Counselors do.    Ms. Crocket moved to cooperate with NBCC on the job analysis and testing with the NCMHCE. Dr. Fischer seconded and the motion carried.

Mr. Shiosaki moved to go into executive session to consider records that are exempt from disclosure as provided in chapter 3, title 9, Idaho Code. Dr. Jones seconded the motion, and it carried.

Dr. Fischer moved to recess at 4:29 and to reconvene at 9:00a.m. tomorrow.  Dr. Jones seconded the motion, and it carried.


FEBRUARY 2, 2005

Chairman Birdsall called the meeting to order at 8:55a.m. with all Board members, Rayola Jacobsen, and Janice Wiedrick present.

Dr. Fischer moved to go into executive session to consider records that are exempt from disclosure as provided in chapter 3, title 9, Idaho Code. Dr. Jones seconded the motion, and it carried.

Dr. Jones moved to come out of executive session.  Ms. Crockett seconded the motion and it carried.

Dr. Freeman moved to change the  Supervisor’s form to read “enrolled in graduate program hours ______ “  and  “post-graduate hours______ .” Dr. Fischer seconded the motion and the motion carried.

Rule 150.02.b needs to provide that Licensed Marriage & Family Therapists are able to supervise those gaining hours for Licensed Professional Counselor (LPC).

The conference call is set for February 8, 2005, at 9:00a.m. Mountain Standard Time. 

Portability

Universities need to:

1.      Be on board with language in place

2.      getting on board  by working on language

3.      or not interested.

Ms. Crocket moved to support adopting portability with public comments, law, and rule changes. Dr. Fischer seconded the motion and the motion carried.

Dr. Fischer moved to change the letters that go out to the new Supervisors  stating that those supervising people working toward the LCPC license, only LCPC Registered Supervisors can supervise all of the hours.  Social Workers, Psychologists and Psychiatrists can supervise 1,000 hours only of the 2,000 hour requirement.  Dr. Jones seconded the motion and it carried.

Dr, Fischer moved to have the Bureau draft legislative language changing the Supervisor for the LPC license to include Marriage & Family Therapists as well. This will be reviewed at the May meeting.

AMERICAN ASSOCIATION OF STATE COUNSELING BOARDS

AMERICAN ASSOCIATION OF MARRIAGE &  FAMILY THERAPY REGULATORY BOARD  September 15-17, 2005  in Phoenix AZ  Eric, Roberta and Jerry to attend.

Media Counseling was discussed.  There are no ethical guidelines set at this time so there is no quality control.  For supervised experience some telephone counseling would be acceptable but not for all of the hours. Mary Barros Bailey is to be invited to the May meeting to discuss this further and review the draft of the rules that Roger is putting together on web-based and other electronic media supervision.

Dr. Fischer moved that all complete applications must be received in this office 7 working days prior to the Board meetings for review.  Anything that comes in after the deadline of 7 working days will be reviewed at the next scheduled meeting. Dr. Jones seconded the motion and it carried.

The Board recessed for lunch and Chairman Birdsall is unable to return after lunch.  Vice-Chairman Roberta Crockett will direct the meeting.

Vice-Chairman Crockett called the meeting to order at 1:30p.m. with Board members: Dr. Jones, Jun Shiosaki, Brenda Freeman, and Dr. Fischer in attendance.

Dr. Jones moved to go into executive session to consider records that are exempt from disclosure as provided in chapter 3 , title 9, Idaho Code.  Dr. Fischer seconded the motion, and it carried.

Dr. Fischer moved to come out of executive session. Dr. Jones seconded the motion, and it carried.

Mr. Shiosaki moved to license those whose applications were approved by the Board.  Dr. Fischer seconded the motion and the motion carried.

Dr. Jones moved to terminate application files that were approved but the applicants never sent in the original license fee to get the original license.   Dr. Fischer seconded the motion and the motion carried.

Dr. Fischer moved to terminate applications that have had no activity or have said they were no longer pursuing licensure in Idaho.  Dr. Jones seconded the motion, and the motion carried.

Dr. Jones moved to adjourn the meeting at 3:05p.m.  Mr. Shiosaki seconded the motion, and it carried.
