Meeting minutes of October 6, 2003

Meeting called to order at 8:30 a.m. by Chair Christine Stutzke.  Those present: Vice President Eric Negaard Carol Martin, Geneal Thompson, and Joni Huff.  Bureau staff present:  Rayola Jacobson, Budd Hetrick, and Kim Aksamit. Legal counsel: Carl Ericson.

Motion by Ms. Martin to accept minutes from June 2, 2003 and September 10, 2003 seconded by Ms. Huff; motion carried.

Ms. Jacobsen Reported on the requested law and rule changes that have been submitted to the Governors office and approved for legislation regarding Statute 54-805 and Rule 24.04.01 491.

Discussion was held on taking license for license. A legislator will carry this before the 2004 legislation session.

Deputy Attorney General Cheri Bush introduced.  

Motion made by Ms. Thompson to go into executive session to discuss matters not subject to public disclosure; seconded by Ms. Martin; motion carried. 

Mr. Negaard; recused himself.

Motion made by Ms. Huff to come out of executive session; seconded by Ms. Martin; motion carried.

L6A-03-03-36:  Moved by Ms. Martin, seconded by Mr. Negaard and carried that case number L6A-03-03-36 be closed and no action taken.

L5B-04-03-45:  Moved by Ms. Thompson, seconded by Ms. Martin and carried that the apprenticeship be terminated and respondents cosmetology instructor right to apprentice be suspended for a period of five (5) years and that respondent pay a One Thousand dollar ($1,000) fine.  Mr. Negaard moved to amend the motion to read apprenticeship be terminated and respondents cosmetology instructor right to apprentice be suspended for a period of five (5) years, respondent shall pay a fine in the amount of One Thousand dollars ($1,000) and pay the cost incurred in the investigation.  Moved by Ms. Martin, seconded by Ms. Huff.

P3B-01-03-24:  Moved by Ms. Huff, seconded by Ms. Thompson and carried that case number P3B-01-03-24 be closed without action due to no evidence to support complaint.  Mr. Negaard and Ms. Stutzke recused themselves from consideration of the matter.

B6-01-03-55:  Moved by Ms. Thompson, seconded by Ms. Huff and carried that Cheri Bush, Attorney General is to draft a Consent Order that respondent’s license be suspended until she can obtain the adequate education for licensure that being a GED or the equivalent of a 10th grade education.  Respondent shall pay a fine in the amount of Two Hundred Fifty dollars and all costs incurred in the investigation.

B5A-01-03-56:  Moved by Ms. Thompson, seconded by Ms. Huff and carried that Cheri Bush, Attorney General send a letter of warning and instruction to respondent in complaint.

Congratulation was given to Ms. Huff for being elected to the National Board as the Secretary of Treasure.

 

Motion made by Ms. Thompson to go into executive session; seconded by Ms. Martin; motion carried.

 

Motion made by Mr. Negaard to come out of executive session; seconded by Ms. Martin; motioned carried.

 

Mr. Hetrick gave the financial report.

 

Discussion was held on having SMT take over law and rule exam; no action taken.

 

Motion made by Ms. Thompson to go into executive session to discuss applicant file; seconded by Ms. Martin; motion carried.

 

Motion made by Mr. Negaard to come out of executive session; seconded by Ms. Huff; motion carried.

 

Motion made by Mr. Negaard to have Julia Provost take the full Cosmetology exam to get a new license issued; seconded by Ms. Huff; motion carried.

 

Report was given by examiners and monitors regarding what has been seen at test site; Discussion was held.

 

Associated Cosmetology School discussed school owner’s overview to be held on

February 2,2004.

 

Testing dates for 2004 were set.

 

Break for lunch

Motion made by Mr. Negaard to go into executive session; seconded by Ms. Martin; motion carried.

Motion made by Ms. Thompson to come out of executive session; seconded by Ms. Martin; motion carried.

Motion made by Ms Martin to deny Sharon Danielson’s request for request of reconsideration she will be expected to go back to school and take 80 hours of training and follow all the rules and regulations of the state board; seconded by Mr. Negaard; motion carried.

COS-2003-3:  Moved by Ms. Thompson, seconded by Ms. Martin and carried that the Idaho Board of Cosmetology Examiners do decline to renew the respondents cosmetology license and that respondent shall pay the cost and attorney fees incurred in the investigation and prosecution.  Ms. Huff recused herself from consideration of this matter.

Ms. Martin and Ms. Thompson are up for re-appointment for Board Members and Examiners up for re-appointment are Ms. Shrum for the Central area and Ms. Lambert for the Northern area.

Discussion was held on the NIC contract; contract was not executed.

Motion made by Ms. Martin to accept additional curriculum for Idaho’s First Academy of Advanced Esthetics to add law and rules and omit nail tech program and are only approved to teach esthetics; seconded by Ms. Thompson; motion carried.  

Motion made by Ms. Martin to accept additional curriculum for Mr. Leons School of Hair Design to add the 500 hour student instructor course; seconded by Ms. Huff; motion carried.

Discussed that eyebrow and eyelash tinting is only to be done by a Cosmetologist not an Esthetician.

Law and Rules can be downloaded from the internet by anyone as long as you do not sell it.
